Terms and conditions
Using this website, and the general terms on which we quote and carry out work.
Last updated 27 September 2026
About these terms
This website (tozerair.com.au) is operated by Tozer Air Conditioning & Electrical (ABN 75 512 852 164), trading as TOZER Air Conditioning ("TOZER", "we", "us" or "our"). By using this website you agree to these terms of use. Part A covers use of the website. Part B sets out the general terms on which we quote and carry out work. Where a written quote or agreement between you and TOZER contains different terms, that document prevails over Part B.
Part A: Using this website
Information on this site
The content of this website is general information about our services and about air conditioning. It is provided in good faith but it is not advice about your particular home, business or system. Sizing guidance, running cost estimates, product features and similar information are indicative only. Whether a particular system suits your property can only be determined by an in-person assessment, and all work is subject to a written quote.
We try to keep the site accurate and current, but we do not guarantee that it is complete, error-free or up to date. Manufacturers change their ranges and specifications, and brand information on this site may lag behind those changes.
Intellectual property
Unless stated otherwise, the text, images, graphics, logos and design of this website are owned by or licensed to TOZER and are protected by copyright and trade mark law. Brand names and logos of manufacturers (including Daikin, Fujitsu, Panasonic and Mitsubishi Electric) are the property of their respective owners and are used to identify the products we install and service. You may view and print pages for your personal, non-commercial use. You must not otherwise copy, reproduce, republish or distribute any part of this site without our written permission.
Acceptable use
You must not use this website in any way that is unlawful, that could damage or interfere with the site or its hosting, that involves submitting false or misleading enquiries, or that attempts to gain unauthorised access to any part of the site or the systems behind it.
Enquiries and forms
Submitting an enquiry through this website is a request for contact. It does not create a booking, a contract or an obligation on either side until a quote has been issued and accepted. We handle the personal information you submit in accordance with our privacy policy.
Links to other sites
This website may link to third-party sites, including manufacturers, social media and mapping services. Those sites are not under our control and we are not responsible for their content or their handling of your information.
Reviews and testimonials
Customer reviews shown on this website are genuine reviews from TOZER customers, reproduced as provided or lightly shortened for length. They reflect the individual customer's experience and are not a guarantee of any particular outcome.
Liability for the website
To the extent permitted by law, TOZER excludes all liability for any loss or damage arising from your use of, or reliance on, this website or its content. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
Part B: Quotes and work
Quotes
Quotes are provided in writing following an in-person assessment and are valid for the period stated on the quote (or 30 days if no period is stated). A quote is based on the site conditions observed at the assessment and the information you give us. If conditions differ materially once work begins, for example concealed structural, electrical or access issues, we will tell you before proceeding and agree any variation with you in writing.
Acceptance and booking
Work is booked once you accept the quote and any deposit stated on the quote is received. Installation dates are scheduled in good faith and may be affected by weather, supply and safety factors. We will let you know as early as we can if a date needs to change.
Your obligations
You must ensure that the property is accessible on the agreed date, that you have the authority to have the work carried out (including any strata, landlord, heritage or council approval that is required), and that you have told us about anything at the property that could affect the safety of our staff or the work, such as asbestos, unsafe roof spaces or unusual electrical arrangements.
Payment
Payment terms are stated on your quote and invoice. Title to equipment supplied remains with TOZER until it is paid for in full. If an invoice is overdue we may charge reasonable costs of recovery.
Warranties
Equipment we supply carries the manufacturer's warranty, the terms of which are set by the manufacturer. In addition, TOZER provides a five-year warranty on the workmanship of installations we carry out, from the date of installation. The workmanship warranty covers defects in our installation work. It does not cover damage caused by misuse, neglect, lack of reasonable maintenance, work by others, storm, flood, pest, power surge or other events beyond our control, or normal wear of consumable items such as filters. To make a claim, contact us using the details below. These warranties are in addition to, and do not limit, your rights under the Australian Consumer Law.
Servicing and repairs
Call-out fees and hourly rates for servicing and repair work are confirmed when you book. Where a fault is diagnosed, we will quote any parts and additional labour before proceeding. We service and repair systems installed by others, but we do not warrant the original installation or the equipment's condition.
Cancellations
If you need to cancel or reschedule booked work, please give us as much notice as possible. Where equipment has been specially ordered for your job, or where work is cancelled without reasonable notice, we may charge our reasonable costs, which we will explain to you.
Liability for work
We carry out all work with due care and skill, and we hold the licences and insurances required to do so. To the extent permitted by law, our liability for any claim relating to our services is limited, at our option, to re-performing the services or paying the cost of having them re-performed. Nothing in these terms limits your rights under the Australian Consumer Law.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
Changes to these terms
We may update these terms from time to time. The current version will always be published on this page with the date it was last updated.
